Terms of Service

Welcome to Gildy. By downloading, installing, or using the Gildy application ("App") or visiting gildy.homegrind.app ("Site"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

These Terms constitute a legally binding agreement between you and Homegrind ("we," "us," or "our"), the developer and operator of Gildy.

1. Acceptance of Terms

By accessing or using the App or Site, you confirm that you are at least 13 years of age, have read and understood these Terms, and agree to be bound by them. If you do not agree to these Terms, please do not use our services.

If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Description of Service

Gildy is an iOS application that allows users to participate in Oscar-night prediction competitions ("Parties"). Users can create or join Parties, vote on Academy Award categories, and compete with friends on a live leaderboard.

3. User Accounts

To use Gildy, you must create an account using Apple Sign-In or Google Sign-In. You agree to:

Provide accurate and complete information when setting up your profile
Maintain the security of your account
Notify us immediately of any unauthorized access to your account
Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

You may submit content such as usernames, party names, and profile photos ("User Content"). By submitting User Content, you represent that:

You own or have the right to share the content
The content does not violate any third-party rights
The content does not contain illegal, offensive, or inappropriate material

You grant us a non-exclusive, royalty-free license to use User Content to operate and improve the App.

5. Prohibited Conduct

You agree not to:

Use the App for any unlawful purpose or in violation of these Terms
Harass, abuse, or harm other users
Impersonate any person or entity
Attempt to reverse engineer, modify, or create derivative works of the App
Use automated systems (bots, scrapers) to access the App
Interfere with the security or proper functioning of the App
Create multiple accounts to circumvent restrictions

6. In-App Purchases

Gildy offers optional paid features, including unlocking larger party sizes for a one-time fee processed through Apple's App Store via In-App Purchase. All purchases are:

Final and non-refundable except as required by applicable law or Apple's policies
Governed by Apple's App Store Terms and Conditions
Subject to applicable taxes in your jurisdiction

Refund requests must be submitted directly to Apple through the App Store.

7. Intellectual Property

All content, features, and functionality of the App — including but not limited to design, graphics, logos, and software — are owned by Homegrind and protected by applicable intellectual property laws. You may not use our trademarks or brand assets without express written permission.

8. Third-Party Services

The App uses third-party services including Firebase (Google LLC), Apple Sign-In, and Google Sign-In. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

9. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

Gildy is a social prediction game for entertainment purposes only. It is not gambling, sports betting, or any regulated financial activity.

10. Limitation of Liability

To the fullest extent permitted by law, Homegrind shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold harmless Homegrind and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the App or your violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice. Upon termination, your right to use the App will immediately cease. Sections of these Terms that by their nature should survive termination shall survive.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above or through in-app notification. Your continued use of the App after changes become effective constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Los Angeles County, California.
